Conditions of participation "FILA x Mary Braun Event in Berlin" cempetition
1. ORGANIZER
The organizer of this competition is D/O Marken + Lizenzen GmbH, Aktienstrasse 32, D- 45359 Essen and is hereinafter referred to as the "Organizer" or "FILA".
2. PARTICIPATION IN THE ONLINE COMPETITION
The "FILA x Mary Braun Event in Berlin" competition starts on 21.11.2023 at 18:00 and ends on 23.11.2023 23:59. Participation and the chances of winning are independent of the purchase of goods or services. By participating in the competition, the participant accepts the following conditions of participation.
- 2.1 Eligibility to participate
The competition is open to all persons aged 18 and over who are permanently resident in Germany, Austria or Switzerland (hereinafter referred to as "participants"). Employees of D/O Marken + Lizenzen GmbH and their relatives are excluded from participation. Only one entry per participant is possible. The participant is responsible for the accuracy of the contact details provided. In the event of a breach of the conditions of participation, D/O Marken + Lizenzen GmbH reserves the right to exclude the persons concerned from the competition. In such cases, prizes may also be subsequently withdrawn. - 2.2 Participation
To take part in the competition, participants must comment on the competition post on Instagram and tag the person they would like to take to the event. The costs of participation (e.g. internet connection) must be borne by the participant. - 2.3 Closing date
The closing date for entries is 23.11.2023, 23:59. Late entries will no longer be considered for participation.
3. DETERMINATION OF THE WINNERS AND PRIZES
- 3.1 Prizes
A total of 15 winners will be drawn from all participants in the "FILA x Mary Braun Event in Berlin" competition. 15 x 2 tickets will be raffled off, each entitling the winner to attend the FILA and Mary Brau event in Berlin. Cash payment of the prize is not possible. Travel costs to/and in Berlin need to be paid by the winners themselves. - 3.2 Determination and notification of winners
The winners for the prize will be selected by lot from all participants. The winners will be notified of the prize by FILA via direct message via Instagram from 24.11.2023. If winners cannot be contacted within three days, FILA reserves the right to select a new winner without owing any compensation.
4. CANCELLATION
D/O Marken + Lizenzen GmbH reserves the right to cancel the competition at any time without prior notice for important reasons. Cancellation for good cause may occur in particular if the proper execution of the competition can no longer be guaranteed for technical or legal reasons. Liability towards participants is excluded in this respect. If such a termination was caused by the intentional behavior of a participant, D/O Marken + Lizenzen GmbH may demand compensation from this person for the damages incurred.
5. LIABILITY
D/O Marken + Lizenzen GmbH constantly strives to provide correct and up-to-date information. Despite the utmost care, no guarantee is given for the correctness and completeness of the contents of the websites listed here and/or these conditions of participation.
6. CONSENT TO THE PUBLICATION OF PHOTO AND VIDEP RECORDINGS
The participants of the competition already agree that photos and video recordings may be made of them at the event. Likewise, the participants agree that the photo and video material created may be published by the organizer on Fila Europe's social media channels without restriction.
7. GENERAL PROVISIONS
If individual provisions of these conditions of participation are or become invalid, this shall not affect the validity of the remaining conditions of participation. Legal recourse is excluded. A cash payment, change or exchange of the prize is not possible. Prize claims are not transferable.
These conditions of participation and the entire legal relationship between the participants and D/O Marken + Lizenzen GmbH are subject exclusively to the law of the Federal Republic of Germany.
Privacy policy for competitions
The General Data Protection Regulation (GDPR), which has been in effect since 25. May 2018 allows the processing of personal data as lawful, inter alia, if the data subject has given consent to the processing of personal data relating to him or her for one or more purposes; the processing is necessary for the performance of a contract to which the data subject is party or for the implementation of pre-contractual measures taken at the data subject's request; processing is necessary for compliance with a legal obligation to which the controller is subject; processing is necessary for the purposes of the legitimate interests of the controller or of a third party, except where such interests are overridden by the interests or fundamental rights or freedoms of the data subject which require the protection of personal data, in particular where the data subject is a child (Art. 6 para. 1 a), b), c) and f) GDPR).
D/O Marken + Lizenzen GmbH (controller) guarantees the confidential treatment of all stored personal data of the registered participants.
As a matter of principle, the organiser only stores the data that is required for the processing of the competition and the registration of the newsletter. Within the framework of this data protection declaration, we would also like to inform participants about how we guarantee the protection of the data they provide. We attach great importance to the protection of all personal data. This personal data will only be collected, processed and used by the organiser in accordance with the currently valid data protection laws (mainly GDPR ). The data is only stored within the scope of the respective purpose for which the personal data was provided to us.
Insofar as other companies are commissioned with the processing of the competition and the sending of newsletters, they are also obliged to protect your data and to use it only for this precisely specified purpose. The processing and storage of your data is necessary in order to fulfil the processing, content design and modification of this competition as well as – subject to your consent - the sending of the newsletter. Overall, the organiser can assure you that no personal data will be collected without your consent; only the participants decide to what extent they wish to disclose this data or not - for example in the context of registration or similar. It may be necessary for the organiser to pass on your personal data to external service providers for further data processing, who are exclusively commissioned with sending newsletters to you.
Participants have the right to obtain information within a reasonable period of time about the type of data stored about them and the purpose for which this data is stored, to have this data corrected or deleted at any time, and to revoke their consent to the use of data and the subscription to the newsletter with effect for the future vis-à-vis the organiser. Both in the case of participation in a competition and in the case of newsletter registration, there is no legal or contractual obligation on your part to provide the personal data, nor is this data required for the conclusion of a contract. If you do not provide this data, however, it will not be possible to participate in the competition or to register for the newsletter.
There is no automated decision-making with regard to the evaluation of your personal data.
